Calculating dates prescribed in court rules is a fairly simple process. However, this can get tricky when trying to determine the exact intent of the rule prescribing the time period.

The following 3-step process can be of use in calculating most time periods.

1. Determine the prescribed period outlined in the rule.

2. Determine if the method of service, if applicable, will afford any additional days to respond.

3. Review the jurisdictions standards for computing time. Specifically, if a certain time period will afford you to omit weekends or holidays in the computation. Secondly, are the additional days, if available, added to period before or after computing when the date would otherwise be due.
