Step 1 – Determine time allowed by rules:
Georgia Uniform Superior Court Rules 6.2 allows 30 days after service of motion for a response.
Step 2 – Determine if additional days are provided due to service:
Georgia Civil Practice Act 9-11-6(e) allows 3 days for service by mail added to the prescribed period.
Step 3 – Review jurisdiction rules regarding time computation:
Georgia Civil Practice Act 9-11-6(a) states that computation rules prescribed in paragraph (3) of subsection (d) of Code Section 1-3-1 shall be used. This subsection states that only periods of time less than 7 days will exclude weekends and holidays.
Application of the rules:
Following this procedure, the due date would be 33 days from May 5, 2008. The 3 additional days are added before computing the period. The 33rd day would land on Saturday, June 7, 2008. Thus, the next court day, June 9, 2008, would be the due date to respond to the motion.
