Step 1 – Determine time allowed by rules:
USDC Colorado Local Rule 7.1 C allows a response to be filed 20 days after the filing date of the motion.
Step 2 – Determine if additional days are provided due to service:
In this case, the triggering event is the filing date. Thus, any additional days for service outlined by Federal Rules of Civil Procedure 6(d) would not apply.
Step 3 – Review jurisdiction rules regarding time computation:
Federal Rules of Civil Procedure 6 (a) states that only periods less than 11 days will exclude weekends and holidays. Therefore, this computation will include weekends and holidays.
Application of rules:
Following this procedure, the due date to respond would be 20 days from May 5, 2008. The 20th day would be Sunday, May 25, 2008. Moving to the next court day, the response would be due on Monday, May 26, 2008.
